1 General Terms and Conditions

The following General Terms and Conditions, in their version valid at the time of service provision, apply exclusively to the business relationship between lafere.ch (hereinafter: "Trainer") and the customer/participant (hereinafter: "Customer").

Customers within the meaning of Section 1, Paragraph 1 are private individuals, companies, and government institutions.
2 Scope of Application
2.1 The following General Terms and Conditions (hereinafter referred to as "GTC") apply to all business relationships between the trainer and the customer for services offered on our website (www.lafere.ch) or specifically agreed upon with the customer. Individual agreements concluded with the customer take precedence over these GTC. Conflicting terms and conditions of the customer are not recognized.
2.2 Lafere.ch reserves the right to amend these GTC at any time. All amendments become effective upon publication of the new GTC on the website. The relevant date for the applicability of the valid GTC is the date of conclusion of the contract. Lafere.ch has prepared these GTC with due care. Should individual provisions or parts of severable provisions nevertheless be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected.

The products offered in the Lafere.ch online shop are exclusively for individuals and companies that are resident or headquartered in the EU, an EFTA state (Switzerland, Liechtenstein, Norway, Iceland), or the UK and can provide a delivery address in one of these countries.

Please read these Terms and Conditions carefully before entering into a contract. By entering into a contract, you agree to the following terms and conditions as well as our Privacy Policy. You also declare that you are legally authorized to enter into binding contracts and are at least 18 years old.
3 Subject of the contract

The subject of the contract is individual advice and support for customers within the framework of the agreed training and running events.
4 Subject of performance

The trainer offers the client individually tailored support. This support includes various recommendations regarding training content, sportswear selection, and route choice. The concept takes into account the client's specific needs and physical abilities.

The trainer guarantees the client individual guidance. The client receives personal support from the assigned trainer.

The trainer strives for a professional and safe execution; however, success, e.g., improvement in running performance, cannot be guaranteed.

5 Training and appointment scheduling

The client can request a personal consultation. During this consultation, the content of the training and the goals will be agreed upon. The client will also inform the trainer about any health and physical limitations they may have.

The duration of the training session is specified upon registration. Longer training sessions are arranged individually with the client.

Appointments are by arrangement only. Appointments must be cancelled at least 72 hours in advance. A fee of 50% of the price of a training session will be charged for missed appointments.

In case of illness/unavailability, an alternative appointment can be offered by arrangement.

Der Trainer behält sich das Recht vor, Trainings aus wichtigem Grund (z. B. The organizers reserve the right to cancel events due to illness of the coach or force majeure. In this case, any payments made will be refunded.
6 Customer obligations

By registering, the customer confirms that they are physically healthy and fit to participate in sports. If you have any pre-existing medical conditions or complaints, consulting a doctor is strongly recommended. The trainer accepts no liability for health risks or consequential damages that may arise from participation.

The client is obligated to inform the trainer of their fitness for sports activities before the start of the training session, without being asked. Should any sudden health problems or discomfort arise during the training, the client is obligated to inform the trainer immediately.

The customer is required to arrive at training with appropriate equipment. If there are any questions, the trainer should be contacted. Customers with inadequate equipment may be excluded from training. Your health is Lafere.ch's top priority.

7 Payment terms for running training and coaching

The trainer's fee can be found at www.lafere.ch and is in CHF.

The invoice is due in full at the start of the training or coaching and can be paid by bank transfer or other methods offered during the booking process..

Participation may be refused in case of late payment.
8 Liability and notices

The trainer is generally not liable for damages incurred by the client. This excludes direct damages caused intentionally or through gross negligence.

Participation is at your own risk. Liability for personal belongings, indirect damages, consequential damages, or lost profits is excluded. Likewise, all damages arising from the use of or inability to access the website or from transmission errors are expressly excluded.

The trainer is not liable for damages resulting from the client's overestimation of their abilities. If the client disregards the trainer's instructions and consequently suffers damages, the trainer's liability is excluded.

The coach has adequate business liability insurance.
9 Datenschutz

The customer's personal data will be stored by the trainer and used exclusively for the fulfillment of the service specified in § 3.

All personal data is processed and treated confidentially in accordance with the Swiss Federal Act on Data Protection (FADP).

11 Confidentiality

Der Trainer ist verpflichtet, über alle im Zusammenhang mit der Erfüllung der Trainingsmassnahmen bekannt gewordenen Informationen des Kunden Stillschweigen zu bewahren. Dies gilt auch nach der Beendigung des Vertragsverhältnisses zwischen dem Trainer und dem Kunden.
12 Copyright and usage rights

All training materials, plans, videos, and content remain the property of lafere.ch and may only be used for private purposes. Commercial use and distribution to third parties are prohibited. Furthermore, the legal provisions for the protection of intellectual property apply, in particular the Copyright Act.
13 Contract duration

Contracts between the trainer and the client are generally only for a fixed term. The client has the right to withdraw from the contract within the first 14 days from the date of conclusion. Termination is excluded unless there is a permanent medical condition that makes continuation of the contract impossible. Only medical certificates are accepted as proof.
14 Final Provisions

Unless otherwise stipulated in these Terms and Conditions, any amendments, additions, or supplementary agreements must be in writing to be effective. This requirement of written form also applies to any waiver of this requirement.

Should any of the foregoing provisions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The parties shall mutually agree upon a suitable, legally valid replacement provision that most closely approximates the intended economic outcome.

The place of jurisdiction is determined by the statutory provisions. Swiss law applies, excluding its conflict of laws rules. Except in the case of disputes arising from consumer contracts, the exclusive place of jurisdiction is Thun, Switzerland. In the case of disputes arising from consumer contracts, the court at the domicile or registered office of either party has jurisdiction for actions brought by the customer, while the court at the customer's domicile has jurisdiction for actions brought by Lafare.ch.

Should any provision of these terms and conditions be invalid, the validity of the remaining provisions shall not be affected.
